1. General Provisions
1.1. These Terms of Service govern the relationship between 3 Krolika LLP (BIN 251240001464, address: 010000, Kazakhstan, Astana, Taras Shevchenko Street 4/1, unit 17) and users of the homiwork.com service (hereinafter "Service").
1.2. The Service provides AI-powered assistance for homework and educational tasks.
1.3. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Educational Disclaimer
2.1. The Service is an educational aid only. It is designed to assist in learning, not to replace independent study.
2.2. We do not guarantee the accuracy, completeness, or correctness of AI-generated answers.
2.3. The Service Owner is not responsible for:
- Any grades or academic results obtained by the User;
- Academic consequences resulting from the use of the Service (e.g., plagiarism accusations);
- Errors in AI-generated content.
2.4. Users must critically evaluate and verify all generated content independently.
3. Content Rights and Commercial Use
3.1. The User may freely use the content they generate to the extent described in Sections 3.2–3.3. To the extent that rights to generated content belong to the Service Owner, the User is granted a perpetual, royalty-free license for such use. Whether copyright arises in content created with generative AI is governed by applicable law.
3.2. Users may use generated content for commercial and any other legal purposes without restrictions from the Service, provided they comply with the laws of their country.
3.3. Users may:
- Place generated content anywhere they want;
- Resell the results of generation;
- Use the Service to provide commercial services to their clients;
- Modify and edit generated content as they wish;
- Use generated content in business, marketing, or personal projects.
3.4. Users are solely responsible for ensuring compliance with third-party copyrights when using reference materials.
3.5. Laws regarding generative AI differ across jurisdictions and are evolving. Users must independently familiarize themselves with the legislation of their jurisdiction before commercial use of content.
3.6. Images generated without the User uploading their own materials (photos or other images) — hereinafter "generic generations" — may be included by the Service in a public catalog of ready-made images and shown to other Users, including in place of re-generating an identical request. Images are reviewed automatically and manually before being included in the catalog.
3.7. With respect to a generic generation included in the catalog, the User — to the extent they hold any rights to it — grants the Service Owner and all users of the Service a royalty-free, non-exclusive license to use the image without limitation of term or territory, including commercial use, reproduction, distribution and modification, without mandatory attribution.
3.8. Where the creation form offers the "Add to the public catalog" setting, the User may opt a specific generation out of the catalog before it is created. Generations already created can be managed in the User's account: generations included in the catalog are marked with a badge and can be unpublished at any time. Unpublishing stops the image from being shown in the catalog going forward and does not affect copies lawfully obtained by other users earlier. The User's first purchase automatically unpublishes all of their generations from the catalog.
3.9. The Service may, at its sole discretion, decline to include an image in the catalog or remove it from the catalog at any time without explanation, including in response to a report submitted via the "Report" form.
3.10. The User agrees not to include personal data or contact details of third parties in prompts or in text on images. The Service filters such images when selecting for the catalog; however, the User remains responsible for the content of their prompts.
4. Energy and Prime Status
4.1. "Energy" is the internal currency used to access Service features.
4.2. Prime Status is a paid subscription that restores energy up to the limit specified in the plan.
4.3. If a User's energy exceeds the plan limit, no additional energy will be restored.
4.4. We reserve the right to modify subscription plans and benefits with prior notice.
5. User Responsibilities
5.1. The User agrees to use the Service for personal educational purposes only.
5.2. The User is prohibited from using the Service to violate academic integrity policies of their educational institution.
5.3. The User acknowledges that relying solely on AI for homework completion is at their own risk.
6. Limitation of Liability
6.1. To the maximum extent permitted by law, the Service Owner's liability is limited to the amount paid by the User for the Service in the last 30 days.
6.2. The Service is provided "AS IS" without warranties of any kind.
